The timing, exactly

20 days

"The notice shall be sent no later than twenty (20) days prior to filing a lien statement" (W.S. 29-2-107(a)). Enter the date you intend to file and the calculator counts back.

"Send" means "to deposit in the mail … with postage or cost of transmission provided for and properly addressed" (W.S. 29-1-201(a)(xii)) — the notice is sent the day it goes into the mail.

The lien statement is filed within 150 days by a contractor and 120 days by every other person, of the earlier of the last work or materials or substantial completion (W.S. 29-2-106(a)) — the notice goes out inside that window.

Who sends it, who gets it

Who sends it

"A lien claimant" — any contractor, subcontractor or materialman about to file a lien statement under the Revised Wyoming Statutory Lien Act (W.S. 29-2-107(a)).

Who gets it

"The record owner or his agent" — one form for each owner (W.S. 29-10-102). The party the money is due from can be copied on the same notice at no extra charge.

What it says

The amount of the lien claim and from whom it is due, and that the lien statement will be filed if the matter is not resolved within twenty days of the notice — the W.S. 29-10-102 form, word for word.

Who has to send the Wyoming notice of intention?

Under W.S. 29-2-107(a), before filing a lien a lien claimant shall send written notice to the record owner or his agent of any claim against the property, stating the amount of the claim and from whom it is due. It applies to contractors, subcontractors and materialmen alike. Whether that describes your claim is a legal question we cannot answer.

When is it due?

No later than twenty days prior to filing a lien statement (W.S. 29-2-107(a)). "Send" means deposit in the mail, properly addressed with postage provided (W.S. 29-1-201(a)(xii)), so the notice is sent the day it is deposited. The lien statement itself is filed within 150 days (contractors) or 120 days (everyone else) of the earlier of your last work or materials or substantial completion (W.S. 29-2-106(a)).

Why is the return receipt included?

The statutory form is headed "CERTIFIED MAIL, RETURN RECEIPT REQUESTED" (W.S. 29-10-102). We mail it that way and the receipt is part of the $39 — not an add-on.

What if there is more than one owner?

The form says to use a form for each owner. Send one notice per record owner; each one is $39 with its own certified mailing and archive.
