Who sends it, who gets it

Who sends it

"A subcontractor, materialman or design professional not in privity with the owner" on single-family residential construction (§ 85-7-409(2)).

Who gets it

The owner — named and addressed in the form's "TO:" line and served by certified mail with tracking, so the delivery is evidenced.

Who is exempt

A party in privity with the owner. On jobs that are not single-family residential, the § 85-7-407 Notice to Contractor is the document instead. The wizard will not sell you a notice you do not need.

Who has to send the Mississippi pre-lien notice?

Under Miss. Code Ann. § 85-7-409(2), as to single-family residential construction only, a subcontractor, materialman or design professional not in privity with the owner must provide the owner a pre-lien written notice at least ten days before filing a claim of lien, as a condition precedent of any right to a special lien. When is it due?

What does the notice change?
